Our Jarocin office specialises in family law. Divorce, maintenance, division of marital property, child contact, parental authority — these are the matters we handle every day. Family law cases from this area are heard before the Regional Court in Kalisz (Sąd Okręgowy w Kaliszu) and the district courts in Jarocin, Kalisz and Ostrów Wielkopolski. These are the courts we appear in regularly.

Divorce

We handle divorce proceedings before the Regional Court in Kalisz — both uncontested and with a fault finding against one or both spouses. Where both parties are in agreement and there is no dispute about the children, the case may conclude at the first hearing. Where fault is in issue or custody is contested, proceedings take longer and require careful preparation of evidence.

A fault finding has real financial consequences — it affects the right to claim spousal maintenance and can be a factor where unequal shares in the division of property are sought. It is worth thinking through the strategy at the first consultation, before any decision is made.

We also assist where a spouse contests the divorce. The other party’s refusal to consent does not prevent proceedings from going ahead, but it does require more robust case preparation.


Maintenance

We assist with establishing maintenance for children and spouses, applying to increase or reduce existing maintenance orders, and enforcing payment when the paying party stops meeting their obligations. We also handle urgent applications for interim maintenance — which can result in the first payment being received within weeks of filing, without waiting for the main proceedings to conclude.

From our experience at the firm, properly documenting the child’s needs and the other party’s financial capacity is decisive for the amount the court ultimately awards. It is worth attending to this from the outset, rather than under pressure at the hearing.


Division of Marital Property

A divorce judgment dissolves the marriage — it does not divide the assets. Division of marital property is a separate matter, dealt with either before a notary (where the parties agree) or through court proceedings (where they do not). The default rule is an equal split, though the court may depart from this in justified circumstances.

We assist with establishing what forms part of the marital estate and what remains personal property, accounting for contributions and debts, and reaching a negotiated settlement — which is faster and cheaper than years of litigation.


Parental Authority and Child Contact

We assist with regulating parental authority after separation — through a parenting plan where the parties can reach agreement, or through the court where they cannot. We represent clients in proceedings to limit or remove parental authority, and in applications to have it restored.

In child contact matters we act both at the stage of establishing arrangements and at the enforcement stage — when one parent is systematically preventing contact. The court can impose financial penalties for each breach of an agreed contact schedule.

We are also handling an increasing number of shared custody cases. Courts in the Kalisz court district are increasingly open to shared custody arrangements where the conditions on both sides support it.


Legal Separation

For those who do not wish to divorce — or cannot — legal separation is a formal alternative that ends the marital community of property and resolves matters concerning the children, while leaving the marriage legally intact. We handle both applications for separation and applications to lift it, where the parties decide to reconcile.


Domestic Violence

In domestic violence cases we act as a priority. We assist with obtaining orders requiring the perpetrator to vacate the family home, restraining orders and contact prohibitions — through both civil and criminal channels. We also advise on litigation strategy in divorce cases where violence is the reason for the breakdown of the marriage.

The first consultation costs 400 PLN and lasts 60–90 minutes. We listen to your account, assess the legal situation and set out the possible scenarios plainly — what you can expect, how long the case is likely to take and what it will cost. If you decide to proceed, the consultation fee is credited towards our overall fee. Payment by instalments is available.

It helps to bring whatever documents you have — the marriage certificate, children’s birth certificates, documents relating to assets and any existing court orders. If you do not have everything, we will tell you what is needed.
