When will the court grant a divorce?
The fundamental condition for a divorce to be granted is the complete and permanent breakdown of the marital union (Article 56 § 1 of the Family and Guardianship Code, Kodeks rodzinny i opiekuńczy). A marital union consists of three bonds: the emotional (psychological) bond, the physical bond, and the economic bond. Where all three have ceased and that state has persisted over a period of time, the court may find that the breakdown is complete and permanent – and only then may it grant the divorce.
What does a divorce judgment contain?
A divorce judgment regulates all significant matters relating to the family – not only the relationship between the former spouses, but also the relationship between the parents and any children of the marriage.
Fault for the breakdown. The court determines whether, and which of, the spouses bears fault for the breakdown of the marital union. It may find sole fault on the part of one spouse, or shared fault on the part of both. On the joint application of both parties, the court may decline to make any fault finding.
Parental authority. The court rules on parental authority (władza rodzicielska) over the parties’ minor children. It may leave authority with both parents, vest it in one parent while restricting the other’s to specified rights and duties, or deprive one or both parents of authority entirely.
Contact arrangements and child maintenance. The court is obliged to rule on each parent’s contact arrangements with the child, and on the amount each parent is required to contribute to the costs of the child’s maintenance and upbringing.
Housing and division of assets. Where the spouses are occupying a shared home at the time of the divorce, the judgment may include a ruling on how that home is to be used after the divorce. On the application of either spouse, the court may also divide the joint marital estate in the divorce judgment – provided that doing so will not cause undue delay in the proceedings (Article 58 § 3 of the Family and Guardianship Code).
