When can the court grant a divorce?
Under Article 56 § 1 of the Family and Guardianship Code (Kodeks rodzinny i opiekuńczy), either spouse may apply for the dissolution of the marriage by divorce where a complete and permanent breakdown of the marital union has occurred. This means that three bonds between the spouses must all have ceased simultaneously: the emotional bond, the physical bond, and the economic bond. The court examines whether the breakdown is irreversible – only then can it grant the divorce.
Which court has jurisdiction for residents of Środa Wielkopolska?
Divorce cases are heard by regional courts (sądy okręgowe) – with jurisdiction determined by the last shared place of residence of the spouses. For residents of Środa Wielkopolska, the competent court is the Regional Court in Poznań (Sąd Okręgowy w Poznaniu).
The court fee for a divorce petition is PLN 600 – a fixed amount that is the same in every court in Poland.
